Definitions

In this Agreement:

BCIS

means Brisbane City Indoor Sports, including its owners, directors, officers, employees, contractors, match officials, volunteers and agents.

Participant

means any person attending the premises for the purpose of Participation in a Recreational Service, including any adult completing this document and any minor listed or registered under this agreement (collectively referred to as "Participants").

Guardian

means the parent, legal guardian, or authorised adult representative submitting this agreement on behalf of one or more minor Participants.

Singular and Plural

In this Agreement, words importing the singular include the plural and vice versa. References to "I", "me", "my", "you", or "Participant" apply equally to each individual Participant named or registered in this submission.

Participation

means involvement in a Recreational Service in any capacity, whether as an active participant (including during periods of non-play), spectator, guardian, or organiser.

Recreational Service

has the meaning given in section 139A of the Competition and Consumer Act 2010 (Cth) and includes all sporting, training, competition, social and recreational activities conducted at or by BCIS.

Activities

include, but are not limited to: indoor soccer, indoor netball, indoor basketball, indoor volleyball, indoor cricket, dodgeball, badminton, pickleball, training sessions, warm-ups, use of equipment, change rooms, any other use of spectator areas and all associated facilities.

Mandatory Statutory Warning

By signing this document, you acknowledge that you are participating in a Recreational Service. Under the Australian Consumer Law, certain statutory guarantees apply to the supply of Recreational Services. These guarantees cannot be excluded in most circumstances, however by signing this document, you agree that the liability of Brisbane City Indoor Sports for any death or personal injury suffered by you as a result of the supply of the Recreational Service is excluded to the extent permitted by law.

Acknowledgement of Inherent Risks

I acknowledge and agree that:

Participation in sporting and recreational activities involves inherent risks, including the risk of serious injury or death.

I understand that these inherent risks may include, but are not limited to, risks arising from:

• Physical exertion and athletic movement, including but not limited to running, jumping, sudden changes of direction and contact with playing surfaces;
• Accidental contact or collisions with other Participants or other party (including referees, officials or spectators);
• Impact with fixed or movable objects, including but not limited to walls, nets, goals, net posts, dividers, equipment or fixtures;
• Equipment failure, movement or misuse, including but not limited to goals, netting, flooring or other sporting equipment;
• The actions, inactions or behaviour of other Participants, referees, or officials, including deliberate, accidental or negligent acts;
• Environmental or facility conditions, including but not limited to lighting, temperature, humidity or surface conditions.

I further acknowledge that the inherent risks of Participation may include, but are not limited to, the possibility of injuries such as:

• Muscle strains, sprains, tears, soreness or cramps;
• Ligament, tendon or joint injuries, including but not limited to the ankle, knee, shoulder, wrist or fingers;
• Bruising, abrasions, lacerations or contusions;
• Dislocations, fractures or other bone or cartilage injuries;
• Head impacts, concussion, and head injury including traumatic brain injuries;
• Back, neck or spinal injury;
• Medical or physiological events associated with physical exertion, including dehydration, dizziness, fainting, nausea, breathing difficulties or heat-related illness;
• Psychological or mental injuries.

I acknowledge that these risks exist even where reasonable care is taken by Brisbane City Indoor Sports, and that not all risks can be eliminated.

I voluntarily accept and assume all inherent risks associated with my Participation in the Recreational Service.

Nothing in this acknowledgement removes or limits any obligation of Brisbane City Indoor Sports to comply with applicable workplace health and safety laws or other statutory duties.

Participant Responsibilities

I agree that I will:

• Participate within my physical and medical capabilities;
• Follow all BCIS rules, Conditions of Entry and safety instructions given by BCIS;
• Use facilities and equipment only as intended;
• Immediately cease my Participation and notify staff if I feel unwell, injured or unsafe; and
• Not engage in reckless, dangerous or prohibited behaviour as outlined in the BCIS rules, Conditions of Entry and safety instructions given by BCIS.

Limited Release of Liability (To the Extent Permitted by Law)

To the extent permitted by law, I agree that BCIS is not liable for loss, damage, injury or death arising from my Participation in a Recreational Service.

Nothing in this agreement excludes liability that cannot lawfully be excluded.

Jurisdiction

This agreement is governed by the laws of Queensland, Australia. Any proceedings must be brought exclusively in Queensland courts.

Acknowledgement

I confirm that:

• I have read and understood this document;
• I understand that I am giving up certain legal rights;
• I enter into this agreement freely and voluntarily.

Where submitted by a Guardian on behalf of one or more minors:

• I warrant that I am the parent, legal guardian, or authorised representative of each minor Participant listed in this submission.
• I enter into this agreement on my own behalf and on behalf of each listed minor.
• I have explained the risks and participant responsibilities outlined in this document to each minor to the extent appropriate to their age and understanding.
